On 3 June 1992, the High Court of Australia delivered its momentous Mabo decision, legally recognising that Aboriginal people and Torres Strait Islanders hold native title to the land – one that existed prior to colonialisation and still exists today.
The Mabo decision was named after Eddie Mabo, the man who faced the Australian Queensland legal system to fight for recognition of the rights of Aboriginal people and Torres Strait Islanders as the traditional owners of their land.
His winning case set the stage for the Native Title rights, which states, “the recognition by Australian law that Indigenous people have rights and interests to their land that come from their traditional laws and customs”.
